Thomas is first mentioned as a knight on 24 Jan. 1440/1 in a charter of his father's.
Sir Thomas was dispossessed of the Earldom of Mar by an assize of error held in the presence of the King James II, on 15 May 1457 at Aberdeen, but in 1467 he was created a peer under the title of Lord Erskine. After loosing the earldom of Mar, Thomas disappeared from public life. He received L100 per year from the revenues of Aberdeen, regularly attended Parliament and took the side of James III in the war of 1488.
The assize of error was later negatived by Queen Mary's restoration and by the ruling of the Court of Session in 1626.
